ESBM-Rechtliche Grundlagen für Remote Work im Alpenraum schaffen

Die Arbeitswelt befindet sich in einem stetigen Wandel. Digitalisierung und die zunehmende Flexibilisierung der Arbeit führen zu einem neuen Megatrend: Remote Work. Dieser beschreibt eine neue Art zu Arbeiten. Arbeitnehmende und Selbstständige arbeiten so zunehmend ort- und zeitflexibel. Gerade das ortsunabhängige Arbeiten bringt für die Regional- und Tourismusentwicklung viele Potenziale und Themen mit sich: Homeoffice, Coworking, und Coworkation sind nur Teilaspekte davon. Gerade Coworkation gilt als einer der führenden Trends in der Regionalentwicklung: Coworkation kann zu einer positiven regionalen Entwicklung beitragen, indem es neue Arbeitsplätze und Wirtschaftstätigkeit in einer bestimmten Region schafft. Coworkation-Programme können dazu beitragen, dass Unternehmen und Freiberufler in ländlichen Gebieten ansässig werden und die lokale Wirtschaft beleben. Aber auch Coworking und aktuelle Entwicklungen zum Thema Homeoffice nehmen starken Einfluss auf regionale Entwicklungen. Indem Coworking und Coworkation die Zusammenarbeit und den Austausch zwischen den Coworkern/Teilnehmern fördert, kann es auch zur Entstehung neuer Ideen und Innovationen führen. Dies wiederum kann zur Entstehung neuer Unternehmen und Start-ups in der Region beitragen, was positive Auswirkungen auf die Beschäftigungssituation und die wirtschaftliche Vielfalt hat. Ein weiterer positiver Effekt von Remote Work Konzepten auf die regionale Entwicklung ist, dass es dazu beitragen kann, dass das kulturelle und soziale Leben in der Region gestärkt wird. Teilnehmer von Coworkation-Programmen können lokale Veranstaltungen und Aktivitäten besuchen, lokale Speisen und Getränke probieren und dadurch das kulturelle Erbe der Region kennenlernen und wertschätzen und sich so auch mit der lokalen Bevölkerung austauschen. Insgesamt kann Remote Work also dazu beitragen, dass eine Region wirtschaftlich und kulturell gestärkt wird und somit zu einer positiven regionalen Entwicklung beiträgt. Auch Fachkräftemangel und -bindung in ländlichen Regionen kann mit Konzepten der Remote Work begegnet werden. Gerade Aspekte von Remote Work wie Coworking oder Coworkation sind relativ neue Begriffe und es gibt kaum spezifische rechtliche Rahmenbedingungen für diese Konzepte. Die rechtlichen Rahmenbedingungen für Coworkations zum Beispiel (aber auch Coworking, Workation oder Homeoffice) können daher von Land zu Land und von Unternehmen zu Unternehmen unterschiedlich sein. Wenn Arbeitnehmer während einer Coworkation für ein Unternehmen arbeiten, gelten in der Regel die Arbeitsgesetze und -verträge des Landes, in dem das Unternehmen ansässig ist. (Coworkation ist ein Begriff, der sich aus den Wörtern "Coworking" und "Vacation" zusammensetzt und eine Art von Arbeits- und Urlaubserlebnis beschreibt. Es ist eine Kombination aus gemeinschaftlichem Arbeiten (Coworking) und Reisen (Urlaub).) Es ist auch wichtig zu beachten, dass für diejenigen, die zum Beispiel während einer Coworkation für sich selbst arbeiten, die Steuer- und Arbeitsgesetze des Landes, in dem sie arbeiten, möglicherweise gelten, unabhängig davon, wo sie normalerweise arbeiten oder wohnen. Gerade um in einer Grenzregion das Thema Coworking und Coworkation (und andere Konzepte von Remote Work) weiter zu entwickeln, ist es wichtig, sich mit den rechtlichen Rahmenbedingungen auseinanderzusetzen und diese zu definieren. Nur so kann das Thema noch mehr an Bedeutung erlangen und der potenziellen Nutzergruppe noch zugänglicher gemacht werden. Und um sich in der Grenzregion noch mehr damit zu beschäftigen soll ein zweitägiges Forum organsiert werden - eine Konferenz mit ausgewählten Fachvorträgen und Impulsen von Expert*innen zum Thema Remote Work und die rechtlichen Rahmenbedingungen. So ist es der Zielgruppe möglich durch die Fachvorträge einen Einstieg/Überblick in die Thematik zu erlangen. Die Zielgruppe des Forums sind neben interessierten Bürger*innen aus der Euregio SBM auch Tourismusverbände, Wirtschaftskammern, Coworking - Coworkation-Anbieter*innen, Bürgermeister*innen und andere kommunale Vertreter*innen, sowie touristische Anbieter*innen. Die Ergebnisse und Inhalte des Forums und dessen Fachvorträgen und Diskussionsrunden sollen dann im Nachgang so aufbereitet und weiter bearbeitet werden, dass auf Basis dessen ein allgemeingültiger Leitfaden/Broschüre für das Thema Remote Work im deutschsprachigen Alpenraum entsteht. Die Broschüre soll dann mit passenden Aktionen der Öffentlichkeitsarbeit vorgestellt und verbreitet werden, dazu gehört u.a. eine Veranstaltung zur Vorstellung des Leitfadens. The world of work is constantly changing. Digitalisation and the increasing flexibility of work are leading to a new megatrend: remote work. It describes a new way of working. Employees and the self-employed are thus increasingly flexible in terms of location and time. Especially the location-independent work brings many potentials and topics for regional and tourism development: Home office, coworking, and coworkation are only partial aspects of it. Coworkation in particular is regarded as one of the leading trends in regional development: Coworkation can contribute to positive regional development by creating new jobs and economic activity in a given region. Coworkation programs can help businesses and freelancers live in rural areas and revitalize the local economy. But coworking and current developments on the topic of home office also have a strong influence on regional developments. By fostering collaboration and exchange between coworkers/participants, coworking and coworkation can also lead to the emergence of new ideas and innovations. This, in turn, can contribute to the emergence of new businesses and start-ups in the region, with a positive impact on employment and economic diversity. Another positive effect of remote work concepts on regional development is that it can help to strengthen cultural and social life in the region. Participants of coworkation programs can attend local events and activities, taste local food and drinks, and thereby get to know and appreciate the cultural heritage of the region and thus also exchange ideas with the local population. Overall, remote work can therefore help to strengthen a region economically and culturally and thus contribute to positive regional development. Also, skills shortages and retention in rural regions can be addressed with concepts of remote work. Especially aspects of remote work such as coworking or coworkation are relatively new terms and there are hardly any specific legal framework conditions for these concepts. The legal framework for coworkations, for example (but also coworking, workation or home office) can therefore vary from country to country and from company to company. When employees work for a company during a coworkation, the labor laws and contracts of the country where the company is based usually apply. (Coworkation is a term that is composed of the words "coworking" and "vacation" and describes a kind of work and holiday experience. It is a combination of collaborative work (coworking) and travel (holiday). It is also important to note that for those who work for themselves during a coworkation, for example, the tax and labor laws of the country in which they work may apply, regardless of where they normally work or reside. Especially in order to further develop the topic of coworking and coworkation (and other concepts of remote work) in a border region, it is important to deal with the legal framework and to define it. Only in this way can the topic become even more important and be made even more accessible to the potential user group. And in order to get even more involved in the border region, a two-day forum will be organized - a conference with selected lectures and impulses from experts on the topic of remote work and the legal framework. This makes it possible for the target group to gain an introduction/overview of the topic through the specialist lectures. In addition to interested citizens from the Euregio SBM, the target group of the forum is also tourism associations, chambers of commerce, coworking - coworkation providers, mayors and other municipal representatives, as well as tourism providers. The results and contents of the forum and its specialist lectures and discussion rounds are then to be prepared and further edited in such a way that a general guide/brochure for the topic of remote work in the German-speaking Alpine region is created on the basis of this. The brochure will then be presented and disseminated with appropriate public relations activities, including an event to present the guide. This should then be made available free of charge.
